Exception when using a top level picture library

Hi

The problem we are facing is that whenever we use a top level picture library or document library (/documents) for the pictures and apply that setting to the web part it throws an exception.

The exception it shows is as follows.

Cannot save the property settings for this Web Part. Exception occurred. (Exception from HRESULT: 0x80020009 (DISP_E_EXCEPTION))

When we use a subsite library the web part works perfectly. I have tested the web part on other site collections and different farms, and the result is the same
